Of Hazardous Waste - Pre-Requisites For Issuing Authorization By SPCB/PCC |
| Foreword
As
per the provisions of Hazardous Waste (Management & Handling) Rules, 1989,
as amended, every occupier handling, or recycler recycling, hazardous wastes including
facility for collection, reception, treatment, transport, storage and disposal
of such wastes is required to obtain authorization from concerned State Pollution
Control Board (SPCB)/Pollution Control Committee (PCC) in UT for any of the said
activities.
Besides, such authorization is also required to be obtained
by any person who intends to be an operator of a facility for collection, reception,
treatment, transport, storage and disposal of hazardous waste.

| After being satisfied
that the operator of a facility or an occupier, as the case may be, possesses
appropriate facilities, technical capabilities and equipment to handle hazardous
wastes safely, the concerned SPCB/PCC is to issue the authorization. However,
this requires examination considering all relevant aspects. Therefore, a checklist
is needed for the same.
The Central Pollution Control Board prepared a
draft document on 'Management of hazardous waste: Pre-requisites for issuance
of authorization by SPCBs/PCCs to waste generators' in the form of a checklist
as directed by the Hon'ble Supreme Court vide order dated October 2003 and widely
circulated among the concerned agencies to invite comments/suggestions for improvement.
The present document is
the finalized version of the aforesaid draft document incorporating the suggestions
and comments received from various agencies.

Maharashtra Pollution Control Board, in preparation of the draft report is gratefully
