Ground Water Cotamination At Sahibabad Industrial Area, Ghaziabad (U.P.)
- On 21.7.2000, an application has
been filed before the Hon'ble Court relying on the News Paper report published
in the "Times of India", dated 13.7.200 that some of the industries located in
the District Ghaziabad are injecting untreated effluent directly into the groundwater
and as a result of the same the water in Delhi is not safe. The Hon'ble Court
directed the Central Pollution Control Board to submit its report.

In compliance of the Hon'ble Court's order, dated 21.7.2000, the Central Pollution
Control Board has undertaken an investigation to ascertain the extent of groundwater
pollution and its source. Investigation has been carried out in and around Sahihabad
Industrial Area as well as at border belt of Delhi-Ghaziabad to ascertain the
apprehension of contaminated of ground water of Delhi as a result of under ground
water travel. The Central Pollution Control Board in its report submitted in the
Hon'ble Court on 25.8.2000, stated that as per ground water characteristic data
there are no indications that the ground water quality of Delhi is being affected
due to travel of groundwater contamination from Ghaziabad area.

On 28.8.2000, the Hon'ble Court has observed that as per report of the Central
Pollution Control Board , the situation is not alarming. The U.P.Pollution Control
Board informed that on the basis of the Central Pollution Control Board's report,
appropriate steps had been taken against the delinquent unit and has been closed
with effect from 1.8.2000. The U.P.Pollution Control Board also stated that the
recommendation of the Central Pollution Control Board will be implemented. The
application has been disposed of with these directions.
11.1.6
Pollution by Distilleries Located in Haryana

In compliance of the Hon'ble Court's orders dated 29.9.2000, 13.11.2000, 8.1.2001,
the Central Pollution Control Board has submitted its reports vide its affidavits
dated 9.10.2000, 4.1.2001 and 12.1.2001 for the consideration of the Hon'ble Court.

On 23.1.2001, the Hon'ble Court observed that the question whether the Distilleries
including M/s Ashoka Distillery should be allowed to operate or not, it has to
be see that adequate measures are taken to safeguard the environment and pollution
is within permissible limits. The Hon'ble Court further directed that it is proper
that a committee consisting of Shri K.Ray Paul, Additional Secretary or such other
senior officer as may be deputed by the Ministry, as well as the Chairman, CPCB
and the Chairman, Haryana State Pollution Control Board should meet and take a
decision with regard to allowing all or any of the Distilleries to operate or
not to operate. The said Committee may seek such technical assistance as it may
deem fit and proper. The application have been disposed of with these directions.
11.1.7
Minimum Flow Of Yamuna Water In Delhi

On 10.5.2000, the Hon'ble Court directed that 125 cusecs of less of
water which may be arrange by the NCT of Delhi from Bhakra Beas Management Board
shall be carried through the State of Punjab and Haryana to Delhi for the purposes
of treatment of the said water by the water treatment plant at Nangloi. This 125
cusecs should be in addition to water which is being released now. This interim
order will be operative till the 31.8.2000. On 21.8.2000 the Hon'ble Court directed
that the interim order, dated 10.5.2000 will continue till further orders.
11.1.8 Vehicular Pollution In Delhi
Writ Petition(Civil)No.13029/1985f (M.C.Mehta Vs. UOI and Others)
On 26.3.2001, the Hon'ble Court directed as follows :
- Those Schools which have as on 31.3.2001
placed firm orders to replace or conversion toCNG are permitted to run their existing
buses upto 30.9.2001 equal to the number of buses for which conversion orders
have been placed.
- The
DTC to run 1880 existing buses for which orders have been placed including the
existing CNG buses which are not more than eight years old till 30.9.2001.
- The
contract carriage buses shall be permitted to ply their existing buses, equal
to the number of existing buses for which steps have been taken to convert or
replace to CNG mode till 30.9.2001.
- The
other bus operators, including stage carriage permit holders, owners of other
commercial vehicles including autos, who have placed firm orders for new CNG vehicles
or for conversion to CNG mode shall also be permitted to operate or equal number
of commercial vehicles, till 30.9.2001, provided the vehicles are not more than
eight year old.
- No commercial
vehicle after 1.4.2001 will be registered in Delhi which does not conform to the
order, dated 28.7.2000.
- The
Hon'ble Court directed the Bhure Lal Committee to examine that Low Sulpher diesel
be regarded as a clean fuel and buses be permitted to run that fuel. The Committee
may submit report as to which fuel can be regarded as 'clean fuel', which does
not cause pollution or is otherwise injurious to health.
11.1.9
Pollution In Gomti River

Mathur Vs. UOI & Ors), the further progress during the period under report is
as follows :-

On 3.5.2000, the Hon'ble Court directed the Central Pollution Control
Board to inspect the other premises also and industries which it has not done
so far. In compliance of the Hon'ble Court's Order, the Central Pollution Control
Board have surveyed and monitored all the seven municipalities located in Pilibhit,
Sitapur, Lakhimpur, Sultanpur, Lucknow, Barabanki and Jaunpur and submitted the
status report on 21.7.2000 before the Hon'ble Court for their consideration.

On 29.3.2001, the Hon'ble Court after consideration of the Central Pollution Control
Board's status report dated 21.7.2000, further directed the Central Pollution
Control Board that it is appropriate that a joint inspection with the U.P.State
Pollution Control Board be conducted to those industries which are polluting river
Gomti . The Hon'ble Court further directed that it appears that Nagar Palika and
Municipalites are directly discharging the polluted water into the river without
treatment. The Central Pollution Control Board has been directed that to submit
a detailed scheme for adoption of modern cheap technologies by which with least
expenses the water could be treated before it is discharged into the river.
11.1.10
Pollution In Bagad River(Gajraula Area,U.P.)

- On 2.5.2000,
the Hon'ble Court directed the Central Pollution Control Board that it would be
appropriate that the Central Pollution Control Board re-inspect the premises of
M/s Insilco located in Gajraula and submit the status report. The Central Pollution
Control Board after carried out inspection of the industry submitted its report
on 26.7.2000 with the recommendations that the industry should continue its efforts
for recovery of Sodium Sulphate from the waste stream and also reduce Flouride
in waste water. The U.P. Pollution Control Board may prescribed the limit of SAR
(Sodium Absorption Ratio), as applicable for discharge of effluent on land for
irregation.

On 22.11.2000, the Hon'ble Court has considered the report of the Central Pollution
Control Board in respect of M/s Insilco, after examination of the report, the
Hon'ble Court further directed that the premises of M/s Insilco would be inspected
in February, 2001 by the Central Pollution Control Board and compliance report
on the recommendation be submitted in the Court. The Central Pollution Control
Board inspected the premises of M/s Insilco on 26.2.2001 and submitted its report
on 20.3.2001 in the Court for their consideration.
11.1.11
Pollution By Industries In Dhar, M.P.
Criminal Appeal No.(s) 151-158
of 1996 (State of M.P.Vs. M/s Kedia Leather & Liquor Pvt.Ltd. & Others)
- On 11.9.2000,
the Hon'ble Court directed that considering the serious consequences of the alleged
air and water pollution due to the discharge by the industries located in district
Dhar, Madhya Pradesh, the M.P.State Pollution Control Board and the Central Pollution
Control Board jointly inspect the premises of these industries and submit its
report. In compliance of Hon'ble Court's orders, the officials of the Central
Pollution Control Board and M.P.State Pollution Control Board have jointly inspected
the industries on 3.10.2000. In its report, the Central Pollution Control Board
informed the Hon'ble Court on 12.10.2000 that M/s Kedia Leather & Liquor Pvt.Ltd.
is not complying the prescribed standards and is non-compliant industry. It was
further informed to the Hon'ble Court that these industries which were found closed
at the time of joint inspection, may not be reopened until adequate waste water
and air pollution control devices are installed and prior written permission of
both the Boards.

On 2.1.2001, the Hon'ble Court after consideration of the joint inspection report
of the Central Pollution Control Board and the M. P. State Pollution Control Board
directed that it appears that for one or the other reason the M. P. State Pollution
Control Board has failed to discharge its function. The M. P. State Pollution
Control Board is directed to take immediate action against M/s Kedia Leather &
Liquor Pvt.Ltd. It was further directed that the three industries which were found
closed on the date of inspection shall remain closed till further orders. The
action taken report is directed to be filed by the M. P. State Pollution Control
Board within six weeks.
11.1.12
Pollution in Porbunder (Gujarat)
Writ Petition
(Civil)No.26/1998 (Kiran Bedi Vs. UOI & Others).
The above
Writ Petition has been filed in the public interest for the protection of the
Monument at Porbunder, the birth place of the Father of Nation. The Hon'ble Court
after issued notices to the Union of India, Archaeological Survey of India, State
of Gujarat, Central Pollution Control Board and others, the matter has been kept
by the Hon'ble Court for monitoring. On 19.9.2000, the Hon'ble Court passed an
order that we are satisfied that sufficient steps have been taken to protect the
birth place of Mahatama Gandhi and the fishing area has been shifted to a distance
of 4½ Kms. The steps are being taken for having the sewarage system in the city
as expeditionsly as possible. In view of the steps taken by the appropriate authorities
no further orders are necessary. The Writ Petition has been disposed of.
11.1.13 Ban on the Import of Toxic Wastes
Writ Petition(Civil)No.657/1995 (Research Foundation for Science,
Technology & Natural Resource Policy Vs. UOI & Others)
The
Writ Petition has been filed in the Public Interest seeking Hon'ble Court's intervention
to impose ban on the import of toxic wastes from the industrialized countries
into India.

On 12.2.2001, the Hon'ble Court after hearing the matter, passed an order that
report of the High Power Committee headed by Prof. M.G.K.Menan has been received.
The High Power Committee has been appointed by the Hon'ble Court vide order, dated
13.10.1997 to look into various aspects of hazardous wastes and suggested measures.
The Union of India has been directed to file their response thereafter other respondents
also file their response.

On 12.2.2001, the Hon'ble Court also consider the report relating the hazardous
wastes off loaded at Alang in Gujarat, the said reports have been filed by the
Central Pollution Control Board vide its affidavits dated 29.2.2000 and 10.8.2000
in compliance of Hon'ble Court's order. The Hon'ble Court has directed that since,
there is no specific finding by the National Institute of Oceanography, Goa, the
Union of India shall file an affidavit indicating whether the material imported
is hazardous or not. If necessary, opinion of the High Power Committee be obtain.
11.1.14
Management of Solid Waste in Class I & Ii Cities in India
Writ
Petition (Civil) No.888/1996 (Almitra H.Patel Vs. UOI & Others), the further progress
during the period under report as follows :
- The Central
Pollution Control Board has submitted its report with respect to five cities of
Bangalore, Delhi, Mumbai, Chennai and Kolkata. The said report has been submitted
by the Central Pollution Control Board before the Court vide its affidavit dated
11.4.2000 and in compliance of Hon'ble Court's order dated 24.11.1999.

On 2.8.2000, the Hon'ble Court has considered the report submitted by the Central
Pollution Control Board. The Hon'ble Court directed the N.D.M.C, M.C.D, D.D.A
and Government of NCT of Delhi to submit their response on the report of the Central
Pollution Control Board. In its report the Central Pollution Control Board has
informed to the Hon'ble Court besides other, one of the recommendation in the
Burman Committee's report in which it is recommended that it is necessary that
there should be public participation for the purpose of maintaining a clean environment.
No municipal authority has responded the said recommendation and without public
participation it will not be possible to clean up the city. It was also stated
that one major obstacle in cleaning up Delhi is the presence of slums.

On 24.8.2000, the Hon'ble Court further considered the report of the Central Pollution
Control Board in which it is stated that the slums are generating lot of untreated
solid waste and adding the pollution load. The Hon'ble Court observed that if
a scheme like "Swachha Bangalore" can be successfully launched with satisfactory
results in the metropolitan town of Bangalore that can be and should be a role-model
for other Cities, especially Delhi.
